In consideration of being permitted to participate in any way in the activities offered by Thomasville Tomahawk, LLC, including but not limited to axe throwing, knife throwing, and ninja star throwing, hereinafter referred to as “Throwing Activities,” I, name listed as below, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to bring legal action against Thomasville Tomahawk, LLC, its officers, employees, and agents from liability from any and all claims resulting from personal injury, accidents, or illnesses, and property losses arising from, but not limited to, participation in Throwing Activities.

I hereby acknowledge that I am at least eighteen (18) years of age, in good physical health and condition, that I am not under the influence of illicit drugs or excessive alcohol as to affect or impair my motor skills, judgment, or general ability to think clearly and with sound mind.

I hereby acknowledge that Thomasville Tomahawk, LLC, its owners and operators have employed diligent effort and care to create a safe environment within the facility and on the premises, and that regardless of such preparations and precautions the participation in Throwing Activities carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I hereby I assert that my participation is voluntary and that I knowingly assume all such risks.

I hereby acknowledge that all rules and safety regulations of my participation in Throwing Activities have been demonstrated and explained to me by a Thomasville Tomahawk, LLC representative, and that I hereby agree to obey and abide by all rules as explained and posted on the premises. I also hereby indemnify and hold harmless Thomasville Tomahawk, LLC, its officers, employees, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorneys’ fees brought as a result of my willing participation in Throwing Activities and to reimburse them for any such expenses incurred. I further acknowledge that I will be held liable for any property damage caused by me while participating in Throwing Activities on the premises of Thomasville Tomahawk, LLC, should said damage be caused by behavior that extends outside of the parameters set forth in the rules and regulations.

I hereby also further expressly agree that the foregoing Acknowledgement and Release, Waiver, and Assumption of Risk Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Georgia and that if any portion thereof is held invalid, it is agreed that the balance of the document will, notwithstanding, continue in full and legal force and effect.

I hereby consent to receive medical treatment that may be deemed necessary and advisable in the event of injury, accident, and/or illness during my participation in this event.

I hereby acknowledge and understand that at this event or related activities I may be photographed or videoed, and that I allow my photograph, video, or film likeness to be used for social media, web, and/or marketing use.

I attest that I have read this Acknowledgement and Release, Waiver, and Assumption of Risk Agreement document in full, that I fully understand its terms, and understand that I am giving up rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend by my signature for this to be a complete and unconditional release of all liability to the greatest extent of the law. I further acknowledge that any questions about the content of this document or use of the premises and facility have been answered by a representative of Thomasville Tomahawk, LLC, and that I fully understand what I am signing.
