WAIVER AND RELEASE OF LIABILITY

This form must be read and signed before the participant is permitted to take part in event sessions.  By signing this agreement, the participant affirms having read it. In consideration of my involvement at NEW YORK BADMINTON CENTER ( also know as NEW YORK BADMINTON CLUB, INC. ), LONG ISLAND BADMINTON CENTER, INC., LONG ISLAND PICKLEBALL CENTER, INC., BROOKLYN BADMINTON CENTER, INC., BADMINTON FOUNDATION OF NY, INC. I acknowledge, appreciate, and agree that:

1.  I risk bodily injury, including paralysis, dismemberment, disability, and death, and while particular rules of the sport, equipment, and discipline may reduce this risk, this risk of injury does exist, as well as the risk of damage to or loss of property. 

2.  I knowingly and freely assume all such risk; both known and unknown, even if arising from the negligence of the releases of others;

3.  I willingly agree to comply with the state and customary terms and conditions for participation.  If, however, I observe any unusual or unnecessary hazard during my presence or participation or if I observe any concern in my readiness for participation, I will immediately bring such to the attention of the nearest official and refrain from participation; and

4.  I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, hold harmless and promise not to sue NEW YORK BADMINTON CENTER ( also know as NEW YORK BADMINTON CLUB, INC. ), LONG ISLAND BADMINTON CENTER, INC., LONG ISLAND PICKLEBALL CENTER, INC. , BROOKLYN BADMINTON CENTER, INC., BADMINTON FOUNDATION OF NY, INC. the committee, their sponsors, their officers, volunteers, staff, sponsors and/or agents, (“releasees”) with respect to any and all injury and loss arising from my participation, whether caused by the negligence of the releasees, the condition of the premises or otherwise, except that which is the result of gross negligence or wanton misconduct, to the fullest extent permitted by law.

5.  I agree to be bound by the rules and regulations of NEW YORK BADMINTON CENTER ( also know as NEW YORK BADMINTON CLUB, INC. ), LONG ISLAND BADMINTON CENTER, INC. , LONG ISLAND PICKLEBALL CENTER, INC. , BROOKLYN BADMINTON CENTER, INC., BADMINTON FOUNDATION OF NY, INC. and I hereby stipulate that I am eligible to play in the events for which I am applying and that I understand that the above mentioned make no representation or warranty with respect to the condition of the premises or the operation of the event. 

6.  I hereby grant to NEW YORK BADMINTON CENTER ( also know as NEW YORK BADMINTON CLUB, INC. ), LONG ISLAND BADMINTON CENTER, INC., LONG ISLAND PICKLEBALL CENTER, INC. , BROOKLYN BADMINTON CENTER, INC., BADMINTON FOUNDATION OF NY, INC. it’s licensees and contracted including photographers, television and motion picture rights including to film or videotape me during matches, narratives, personal interviews, or comment thereon for any and all commercial, news or other purposes together with the right to transfer or grant their rights to others, all without remuneration or compensation to me whatsoever.  

7.  SMS Consent Waiver: By providing my mobile number and opting into this SMS (Short Message Service) consent, I acknowledge and agree to the following:

1. Consent: I consent to receive promotional and informational messages via text message from NEW YORK BADMINTON CENTER ( also know as NEW YORK BADMINTON CLUB, INC. ), LONG ISLAND BADMINTON CENTER, INC., LONG ISLAND PICKLEBALL CENTER, INC. , BROOKLYN BADMINTON CENTER, INC., BADMINTON FOUNDATION OF NY, INC ( all refer as The Clubs ) to the mobile number provided. I understand that message and data rates may apply.
2. Frequency: I understand and agree that message frequency may vary and that I may receive multiple messages per month.
3. Opt-Out: If at any time I wish to opt-out of receiving SMS messages, I can simply reply with the keyword "stop" to any message I receive. I will then no longer receive text messages from "The Clubs" .  
4. Opt-In: After opting out, I can opt-in by simply replying with the keyword ‘start’ or ‘unstop’.
5. Privacy: "The Clubs" respect my privacy and will only use my mobile number for the purposes outlined in this consent .
6. Content: While "The Clubs" strive to provide accurate and valuable information through SMS, they cannot guarantee the accuracy, completeness, or reliability of the content. Any reliance on the information provided is at my own risk.
7. Liability: "The Clubs" shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the SMS.
8. Amendments: "The Clubs" reserve the right to amend or modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting the updated terms on their website or sending me a notification via SMS.
9. By providing my mobile number and opting into the SMS consent, I acknowledge that I have read, understood, and agreed to the terms and conditions outlined above. If there is any disagreement with any of these terms, I understand that I need to contact management immediately.
